Accessorial Charges: 

Item 1 Extra Stop Off.

           $100.00 1st drop, $200.00 thereafter.

Item 2 Minimum Trailerload Charge.

           $750.00

Item 3 New York Pick-Up and Delivery.

           An additional charge of $550.00 will apply for New York areas named.

           Bronx - Kings (Brooklyn) / Queens - Richmond (Staten Island) /

           New York (Manhattan) and Long Island, NY. (Applies to Zip Codes 100 thru 119).        

Item 4 Team Services.

When team drivers are required an additional charge of  .35 cents per loaded mile will apply.  Team services will be determined by the actual pick up to delivery time requested using the transit schedule.

Item 5 Fuel Surcharge.

All truckload shipments will be subject to a fuel surcharge when warranted by an increase in the national fuel average as provided by the Energy Information Administration Diesel Fuel and Motor Gasoline Hotline.

Item 6 Detention with power units and layover.

Loading and unloading time will run from the time carrier's vehicle arrives at the site (or from scheduled appointment time) until such time all necessary shipping or receiving documents have been executed and the vehicle is released for departure.

           a) Two - (2) hours free time will be allowed for loading at origin.

           b) Two - (2) hours free time will be allowed for unloading at destination.

           c) Time consumed in excess of free time (a) and (b), for any reason beyond the

           control of the carrier, will be charged for at the rate of $50.00 per hour, during   

            normal business hours of 7am to  5pm Monday through Friday.  If carrier is required

to remain overnight to accomplish pick up or delivery a $250.00 charge will apply. (This includes multiple pick-ups or drops in the same area that cannot be accomplished during normal business hours of that day). Such charges are in addition to all other charges.

Item 7 Detention without power units.

Applies when carrier's trailer is delayed at the consignor, consignee, or on other premises designated by the customer, through no fault of the carrier. Expiration of 72 hour free time: The charges are: $35.00 per day; including weekends. 

 

 

 Item 8           Overweight Shipments.

Carrier will not be liable for charges resulting in shipper loading vehicle in excess of the state legal minimum weight or 45,500 pounds.  Any resulting fines will be added to the freight charges.  If carrier is required to unload a part of the shipment, extra labor charges will be applicable.

a) When the maximum weight for a shipment is exceeded, and the rate is stated in"cents per mile", an additional five cents for each additional 500 pounds or fraction thereof will be assessed per loaded mile.

b) When carrier is required to return to shipper to comply with legal weight, shipper will remove cargo or shift cargo to comply with applicable weight laws.  A charge of $2.50 per running mile will be assessed to freight charges to comply with this Item, not to exceed two hundred (250) miles from origin.

Item 9 Reconsignment or Diversion          

a) If a change in destination is requested in time to accomplish at origin terminal, the charge of $100.00 per shipment will apply.

           b) When a request is made to reconsign while shipment is enroute to delivery, a charge of                    $150.00 will apply.                         

           c) When request is received after tender, the charge will be $200.00 per vehicle.

Charge will be the published rates to reconsignment point, to include miles from original point of origin to ultimate destination.  Any delay will be subject to detention charges.

Item 10 Vehicle Furnished - But Not Used

When a carrier is requested to furnish a vehicle to pickup a truckload shipment and the vehicle is not used due to no fault of the carrier, a charge of $300.00 per day or fraction thereof per vehicle will be assessed against the party making such request.  If outside the terminal area a vehicle is dispatched and not used through no fault of the carrier, a charge of $2.00 per mile subject to $300.00 minimum charge will be assessed.  The mileage will be computed from the carrier's origin point, plus mileage back to next pick up point.      

Item 11 Loading by Consignor - Unloading by Consignee

When carrier is requested to assist in loading or unloading,  $200.00 charge will apply. If  lumper is required, actual cost will be charged back.         

 

 

 

 

 

 

Item12 Storage

Freight held in carrier's possession by reason of an act of the consignor, consignee or    owner, and through no fault of the carrier, will be considered stored immediately. Such freight will be subject to the following charges, beginning 7am the next day after notice

Of arrival is given.  Freight subject to truckload-$55.00 per shipment per day; plus any   mileage charge that may apply to move shipment to carrier terminal.

 

Item 13 Saturday, Sunday or Holiday (As observed locally) Delivery

            When carrier is requested to deliver on Saturday, Sunday or a holiday

            (as locally observed), an additional service charge of $300.00  will apply. 

          

Item 14 Time Sensitive Shipments - (Hot Shot Service)

  Priority service will be provided at $3.25 per mile.

 

Item 15 Cargo Claims

Cargo Claims provisions are as follows:  All disputes or disagreement with declination        of a claim is limited to sixty days after declination is received in writing.  For all     unresolved claims the sole remedy will be through third party arbitration.  All claims must be filed for actual cost of merchandise unless claimant has a loss of sale.  With proven loss of sale a claimant may file a claim for the sales invoice cost.  No claim will be considered for payment until all freight charges are paid in full.  All used machinery will be transported exclusively with a released value shown on the bill of lading.  If no value is stated, RVNX will be .10 per pound.  Trailers are dropped for loading and/or unloading at the mutual consent and agreement of the customer and TTMS.  The customer will notify TTMS of any and all exceptions within twenty-four hours of the time and date of dropping the trailer.  Failure to notify TTMS within stated time period will be considered by both parties as justifiable reason for declination of any claim arising from shipments delivering on said trailer. 

 

Item 16 Service Liability

In no event shall Carrier be liable to Shipper or anyone else for special, incidental, or consequential damages that relate to loss, damage or delay to a shipment, unless Shipper has informed Carrier in written or electronic form, prior to or when tendering a shipment or series of shipments to Carrier, of the potential nature and type of such damages, and Carrier specifically agrees in written or electronic form to accept responsibility for such damages.  In no event shall Carrier be liable to Shipper or anyone else for punitive or exemplary damages that relate to loss, damage or delay to a shipment.
